Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Stay & Go EV ("Company," "we," "us," or "our"), governing your access to and use of the website located at stayandgoev.com (the "Site") and any products purchased from the Site.

You accept these Terms by: (a) visiting or using the Site; (b) clicking "I agree" or any equivalent acceptance prompt; (c) placing an order; or (d) accepting delivery of any product. If you are purchasing on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years of age to purchase from this Site. By placing an order, you represent that you meet this requirement.

Independent Product — No OEM Affiliation

Stay & Go EV is an independent company. Our products are not manufactured by, affiliated with, sponsored by, approved by, endorsed by, or in any way connected with Tesla, Inc., any other original equipment manufacturer ("OEM"), any vehicle manufacturer, or any charging network operator.

References on this Site to "Tesla," "Model 3," "Model Y," "Model S," "Model X," "Cybertruck," "Supercharger," "NACS," and similar terms are made solely for the purpose of identifying compatible vehicle or charging connector types under the doctrine of nominative fair use. Such references are not intended to suggest, and do not create, any affiliation, sponsorship, approval, or endorsement by the respective trademark owners.

All third-party trademarks, service marks, and trade names referenced on this Site are the property of their respective owners.

Products & Descriptions

We make reasonable efforts to display product descriptions, images, specifications, and compatibility information accurately. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or free from errors.

Compatibility

Compatibility of Stay & Go EV products can vary significantly by vehicle model, model year, charge-port hardware revision, charger generation, software version, adapter type, and configuration. Compatibility information provided on the Site is provided for general guidance only and does not constitute a guarantee that a product will function with your specific vehicle or charging setup. It is your responsibility to verify compatibility before purchase and before use. A return will not be accepted solely on the basis of incompatibility where that compatibility limitation was disclosed on the Site prior to purchase.

Product Changes

We reserve the right to modify, discontinue, or substitute any product at any time without notice. Prices, descriptions, and availability are subject to change without notice.

Pricing & Payment

All prices are listed in U.S. dollars. We reserve the right to change prices at any time. The price charged for your order will be the price displayed on the Site at the time of order placement, subject to correction of pricing errors.

We accept payment through Shopify Payments and any other payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate. Payment must be received and confirmed before we process or ship any order.

We are not responsible for any fees charged by your bank, credit card issuer, or payment processor in connection with your purchase. You are responsible for all applicable taxes associated with your purchase. Where required by law, we will collect and remit applicable sales taxes.

If your payment is declined or reversed, we reserve the right to cancel your order and seek recovery of any amount owed, including any chargeback fees imposed on us.

Orders & Cancellations

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to limit, refuse, or cancel orders at any time for any reason, including but not limited to: product unavailability, errors in pricing or product description, or suspected fraudulent activity. If we cancel your order, we will refund the amount charged.

Orders may be canceled only before fulfillment or shipment has begun. Once an order has entered the fulfillment process or been shipped, it cannot be canceled and must instead follow our Return & Refund Policy. To request a cancellation before fulfillment, contact us immediately at stayandgoev@gmail.com with your order number.

We reserve the right to refuse service, cancel accounts, or cancel orders at our sole discretion.

Shipping

We ship within 1–3 business days of confirmed payment. We ship within the United States. Estimated delivery times are provided by carriers and are estimates only — we do not guarantee delivery dates and are not liable for carrier delays, weather events, or other circumstances outside our control.

Risk of loss and title for products purchased from us pass to you upon delivery to the carrier. If your shipment is lost or damaged in transit, contact us at stayandgoev@gmail.com and we will assist in filing a claim with the carrier, but we are not liable for loss or damage occurring after handoff to the carrier.

You are responsible for providing an accurate and complete shipping address. We are not liable for orders delivered to an incorrect address provided by the customer. Reshipping charges, if applicable, are the customer's responsibility.

Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Key terms include a 14-day return window for unused, uninstalled, and unmodified items; a 20% restocking fee on eligible non-defective returns; customer responsibility for return shipping costs; and a Return Merchandise Authorization (RMA) requirement before shipping any return.

Products that have been installed, used, tested on a vehicle, modified, or damaged are not eligible for return for change of mind or buyer's remorse.

Nothing in our Return & Refund Policy or these Terms is intended to limit rights that cannot be lawfully limited under applicable consumer-protection or warranty law.

Product Use & Assumption of Risk

Nature of the Product

Stay & Go EV products are mechanical convenience and preparedness accessories only. They are not emergency equipment, not personal safety devices, not life-safety systems, and not certified for any safety-critical application. Our products have not been tested, certified, or approved by any government agency, vehicle manufacturer, or standards body as safety equipment.

Our products do not guarantee the release of a charging connector in any specific situation. Performance will vary based on connector condition, vehicle hardware, charger hardware, ambient conditions, and user technique. There is no guarantee that a Stay & Go EV product will work in any particular situation.

Required Sequence of Use

Before using any Stay & Go EV product, you must first attempt all normal connector release methods available on your vehicle, including but not limited to: (a) using the vehicle's touchscreen; (b) using the manufacturer's mobile app; (c) using any physical charge-port release button or lever on the vehicle; and (d) contacting the charging network operator or emergency services if appropriate. Use of our product is intended only as a secondary option when all normal methods have failed.

Prohibited Uses

You must not use any Stay & Go EV product to:

• Force a connector that is engaged or locked by a charging network's active lock mechanism
• Defeat, bypass, or interfere with a charge-port locking mechanism in a manner not sanctioned by the vehicle manufacturer
• Modify, alter, or attempt to repair any charging equipment
• Use with damaged, corroded, improperly maintained, or incompatible charging equipment
• Violate any applicable law, regulation, charging network agreement, property owner restriction, or vehicle manufacturer policy

Assumption of Risk

By purchasing and using a Stay & Go EV product, you voluntarily and knowingly assume all risks associated with its use, including but not limited to: risk of physical injury; risk of damage to your vehicle, charge port, or charging equipment; risk of voiding your vehicle's manufacturer warranty; risk of violating a charging network's terms of service; and risk of any other adverse consequence. You acknowledge that you have read all instructions provided with the product and will use the product only as directed.

No Endorsement of Risk-Taking

Nothing in these Terms or our marketing materials should be construed as encouraging you to remain at a charging station in an unsafe situation, to delay calling emergency services, or to prioritize retrieving a vehicle over personal safety. If you are in a dangerous situation, contact emergency services immediately.

Disclaimer of Warranties

Limitation of Liability

Indemnification

You agree to defend, indemnify, and hold harmless Stay & Go EV and its owners, officers, employees, agents, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use or misuse of any Stay & Go EV product; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third party's rights, including the terms of service of any vehicle manufacturer, charging network, or property owner; or (e) any damage you cause to third-party property or equipment using our products.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such matter.

Intellectual Property

Stay & Go EV Property

The Site and all of its content — including but not limited to text, graphics, photographs, logos, product designs, and software — are the property of Stay & Go EV and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, transmit, modify, create derivative works from, or commercially exploit any portion of the Site or its content without our express written permission.

Third-Party Trademarks

Tesla, Model 3, Model Y, Model S, Model X, Cybertruck, Supercharger, and other OEM trademarks referenced on this Site are the property of their respective owners and are used for compatibility identification purposes only under nominative fair use. Such use does not imply affiliation, sponsorship, or endorsement by any trademark owner. We do not claim any ownership of or rights to such marks.

User Content

If you submit reviews, feedback, photos, or other content to us, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content for any business purpose, including marketing and product development.

Prohibited Uses

You agree that you will not use the Site or our products to:

• Violate any applicable law, regulation, or ordinance
• Infringe the intellectual property or other rights of any third party
• Engage in fraudulent activity, including submitting false or misleading orders or chargebacks
• Attempt to gain unauthorized access to our systems or data
• Use automated means (bots, scrapers) to access or collect data from the Site without permission
• Interfere with the proper functioning of the Site
• Resell our products in a manner that misrepresents their origin, nature, or the identity of the seller
• Make false or misleading claims about our products or their performance

Privacy

Our collection, use, and disclosure of personal information in connection with the Site and your purchases is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site or purchasing our products, you consent to the collection and use of your information as described in the Privacy Policy.

We use Shopify to operate our store. Shopify's privacy practices apply to data processed through their platform. We process payment information through Shopify Payments and do not store raw credit card data on our own servers.

Third-Party Links & Services

The Site may contain links to third-party websites, including vehicle manufacturer sites, charging network sites, and other resources. These links are provided for convenience only. We do not control, endorse, or assume any responsibility for the content, privacy practices, or accuracy of any third-party website. Your use of third-party websites is at your own risk and subject to their respective terms and conditions.

Governing Law & Venue

These Terms and any dispute arising out of or related to these Terms or your use of the Site or our products shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Subject to the arbitration agreement in Section 17, any legal action or proceeding arising under these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Colorado, and you hereby consent to personal jurisdiction and venue in such courts.

Dispute Resolution & Arbitration

Informal Resolution First

Before initiating arbitration, you agree to contact us at stayandgoev@gmail.com and give us a reasonable opportunity — at least 30 days — to resolve the dispute informally. Most concerns can be resolved quickly this way.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, our products, or the Site — including questions about the existence, validity, or scope of this arbitration agreement — shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at adr.org.

The arbitration shall be conducted on an individual basis. The arbitrator shall have the authority to award any remedy available in court, subject to the limitations in Section 10. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Opt-Out Right

You may opt out of this arbitration agreement within 30 days of your first purchase by sending written notice to stayandgoev@gmail.com with the subject line "Arbitration Opt-Out" and including your name, order number, and a statement that you wish to opt out. Opting out does not affect your other rights under these Terms.

Small Claims Exception

Either party may bring a qualifying claim in small claims court in lieu of arbitration, provided that the claim remains in small claims court and is not removed or appealed to a court of general jurisdiction.

Class Action Waiver

State-Specific Consumer Rights

California Consumers

California consumers have specific rights under the California Consumer Privacy Act (CCPA) and the California Song-Beverly Consumer Warranty Act. Nothing in these Terms limits any rights granted to California consumers under California law that cannot be lawfully waived. Pursuant to California Civil Code § 1789.3, California residents may report complaints to: Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

New Jersey & Other States

Certain states do not allow limitations on implied warranties or the exclusion of certain damages. If you reside in such a state, some of the limitations in Sections 9 and 10 may not apply to you, and you may have additional rights. These Terms give you specific legal rights; you may also have other rights which vary from state to state.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. We may also notify you by email or a prominent notice on the Site, but we are not obligated to do so.

Your continued use of the Site or purchase of our products after the updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and refrain from placing further orders.

General Provisions

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Stay & Go EV with respect to your use of the Site and purchase of our products, and supersede all prior agreements, representations, and understandings.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Stay & Go EV.

Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, or sale of assets, without restriction or notice to you.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, pandemic, supply chain disruptions, carrier delays, or government restrictions.
